Street vendor fix passes first reading

HONOLULU-  A bill that would allow lunch wagons and other street vendors to remain at a single location for two hours instead of fifteen minutes passed the first of three required readings Wednesday at the Honolulu City Council.

The measure was introduced by Councilwoman Tulsi Gabbard after Honolulu Police began citing lunch wagons and other street vendors several months ago under what many say is an outdated law. 

The 1978 city ordinance requires street vendors to move at least 300 feet after being at a location for just fifteen minutes.  Violators face a petty misdemeanor charge punishable by up to 30 days in jail and as much as a $1,000 fine.

Kathy Sills, who sells homemade popsicles under the brand name Aloha Ice Cream Tricycle, was cited for violating the ordinance on August 20 of last year.

However District Judge Linda Luke found Sills not guilty after ruling the ordinance did not specify if the sidewalk Sills was on was actually part of the street.

“Because it’s vague as to street or sidewalk, it’s too vague period,” said Marcus Landsberg, Sills’ attorney. 

Even with the not guilty verdict Sills continues to be visited by police officers whenever she brings her popsicle laden tricycle to the front of the King Kamehameha statue on South King Street.  As a result, Sills’ business has suffered.

“I was doing probably about 150 (popsicles) a day, now I'm lucky if I do fifty.” 

Sills has also cut back on the number of days she visits the popular tourist destination, from five or six days a week to just two.

That just speaks to the necessity of passing this bill as quickly as possible,” said Gabbard.  “It is having a direct impact on people being able to just go about their business.”

The creator of Eat the Street, a monthly gathering of lunch wagons in Kakaako, told Khon2 some lunch wagons may go out of business if Gabbard’s fix of the 1978 ordinance wallows in the City Council.

"Without this law being passed as soon as possible they can't survive past a week for many of them,” said Poni Askew.  “Week-to-week, day-to-day they survive.”

The new Bill is close to perfect, but as written right now would do much more harm than good: It makes jailable overstaying the meter or not turning on a blinker. http://landsberglegal.wordpress.com/2012/01/26/food-trucks-in-hawaii-honolulu-food-truck-bill-59/

Hey Chuck! I rather SEE a lunch wagon taking up SPACE in a parking stall or LOADING ZONE, doing business and like Olos73, people have ONLY 1/2 hr to eat...unlike some others who can take 1 HOUR to eat! The city should crack down on Loading zone violators who BLOCK commercial vehicles from doing deadline chores...I applaude "rookies" on the River Street route and the meter officers who watch out for us! Mahalo!

Who orders HPD to go after funds from lunch wagons, and goes after CHILDREN S zoo fees as if there's NUTHIN else to do? Mayor Carlisle! HE is trying to find ways to fund this city while spending rail funds for his personal goals. See KHON's past reports on the rail taxes.

The lunch wagons are great... Would you rather they be on welfare ??? I stop at these lunch wagons every chance I get. HPD better not come between me and supper...

Sorry, but why are lunch wagons allowed to take public space to sell food? Why are people not allowed to sit in the middle of downtown and sell T-Shirts or other goods? I go to lunch wagons too, but they should be renting the spaces that they are taking. Don't forget that many make well over $100,000 cash money a year after expenses.

People complain that lunchwagons take away business from restaurants. Not all restaurants are closeby to customers. Workers have a short amount of time for lunch breaks. I'd rather go out to the street, pick up a plate lunch and eat on a bench. Don't have to wait for waiter/waitress to take my order, wait for meal to be cooked, eat, then rush back to work. Lunchwagons makes it more convenient for lots of people.

I love lunch wagons. I wished they can stay as long as they like. They are always dirt cheap and always something different instead of our everyday stores. Lunch wagons are like my hero. Im always curious to see what they have. So many choices! ^_^

The lunch wagons should be allowed at least 3 hours. Businesses have varying hours when it comes to lunch breaks. That's just my opinion. Oh, by the way, KHON2, you need to correct the spelling of "Honolullu". Mahalo.
