Occupiers told 16 other parks are good for overnight use

Prosecutors are pursuing charges against six Occupy Honolulu protestors, saying the defendants could have protested at one of 16 parks on Oahu that are open at night.

Instead, the group chose to gather at Thomas Square, which closes at night.

Last November, police arrested six people for refusing to leave the park after it closed.

Prosecutors pointed to a group that protested APEC, also last November, without breaking any laws.

"An organization called World Can't Wait Honolulu filed for a permit. They received a permit and they used Old Stadium Park as a staging area for the duration of APEC," said prosecuting attorney Cathy Lowenberg.

"Use of a staging area is not political expression and that's not the expression the defendants wanted to make. The ability to use a staging area is not the same," said defense attorney Eric Kram.

The defendants argue their right to free speech was violated.

The case will continue next month.

Public parks are closed to keep people from partying, doing drugs, rape, and various other criminal things in them. Parks are a privilege not a right. There is a difference. Parks are maintained by the city so they say when it closes. If you have a problem with it, open your own public park and pay to maintain it and let people do whatever they want in it 24hrs a day. Comparing park closures to martial law is beyond stupid. You can stay in a bar because there are people there to help maintain order.

Wow, I didn't realize there were 16 parks on Oahu that were open at night. Everywhere I go, I see the blue signs that say closed from 10pm to 5am. Like nobody has any legitimate business for being out during that time. I'd like to see the list of 16, I bet their just little pieces like triangle parks, but I'm curious to see the list. Public places should not be closed at night anyway. Who gets to say when you can and can't use public land? We are the public. I think it's just easier for law enforcement when every public place is off limits after 10pm, then it's like Martial Law. The only place you can be after 10pm is in your home or in a bar. You can be in a bar until 4am, but you can't be in a public park after 10pm. That's crazy. What kind of place do we live in now? This sounds like communist Russia. Any public place that you could think of being on this island has a blue sign posted saying that you can't be there from 10pm to 5am. Myself and a KCC student who I was helping with her photography project got hassled for 45 minutes at the lookout at Diamond Head because we were taking pictures of lightening at 11pm. There were about 20 cars there, and the cop picked out us 2 because we had cameras. He was so bad that other people volunteered to be witnesses for us if it went to court. A good lightening show doesn't happen that often on this island, and at 11pm there was like no public place we could find that was not off limits that would give us a good view for the photographs. This is not the free country that I gave 20 years of my life for in the military. I want it back. We keep making new rules, but none ever go away. Eventually you can't leave your house without breaking the law. Hitler's Germany is unfolding before our eyes in this once great country. These kids may have broken the law, but the law should have never been there to begin with. The cops should do their job to enforce the real criminals, and leave the rest of us to our freedom. Serve & Protect.

their lawyer gets paid to be stup_ID ??? Arrested for being in a closed park and refusing to leave... How does that conflict with their right to protest and free speech ???? I hope their not paying their lawyer too much, the guys and ID_IOT...

Your right to free speech was violated because you were arrested for being in a park after it closed? Riiiiiiiiiiiiiiiiiiiiiiiiiiiiiiight... These dummies should be tossed in jail.
