Lesbian couple files discrimination lawsuit against Hawaii business

A lesbian couple who tried to rent a room from a Hawaii Kai bed and breakfast in late 2007 filed a civil lawsuit today alleging discrimination.

Diane Cervelli and Taeko Bufford of Los Angeles claim they were refused accomodations at "Aloha Bed and Breakfast" on Mariner's Ridge because of their sexual orientation.

"I was told by the owner that she could not rent us a room as she was uncomfortable with same sex couples," said Cervelli

"We just wanted to be treated like everyone else, any other paying customers. and it's not about changing her beliefs or changing her religion, it's about accepting us like you're accepting any other client that comes in there," said Bufford.

The couple is represented by Lamda Legal, a civil rights group for homosexual and transgender people.

The owner of the bed and breakfast, Phyllis Young, directed questions to her attorney, who did not return our phone call.

"buster" can't read... never assumed gay... as to your business, don't want it, don't need it... I don't have any openings anyway (must be my poor customer service)... and no gays... gee, must be my (said owners) choice eh? next tenant...

Someone said they weren't sure I was right about something. I would first say that I'm pretty sure that this couple has a rock solid case. The owner apparently admitted that she doesn't allow gay couples to stay in her B&B. This is transient housing, which clearly falls under Hawaii's public accommodations laws. Now as for my contention about the federal Fair Housing Act, I am a landlord and have gone over this. http://www.justice.gov/crt/about/hce/title8.php "(b)Nothing in section 804 of this title (other than subsection (c)) shall apply to-- (1) any single-family house sold or rented by an owner: Provided, That such private individual owner does not own more than three such single-family houses at any one time" I don't discriminate on the basis of race, sexual orientation, religion, etc. However, I'd think hard before I'd rent to someone disabled who might ask for expensive modifications. The law actually protects small-time landlords, especially those who rent out two story homes with stairs. I couldn't afford to install a wheelchair lift, and the law doesn't force me to do so.

funny how 'jusme101' just assumes that i am gay. i stated that i want to know what the name of your business is so that i could stay away from you when i stay at b&b's. you don't tolerate gays ... i don't tolerate you. but that's okay if you don't want to tell me. i can recognize poor customer service and intolerance just by a few sentences you speak. you'll lose my business. who cares, right?

Tolerance is a two way street, gays also need to be more tolerant of people who do not wish to be around them, they should be more tolerant and respect others.

What good would a boycott do against my business ???? I don't rent to gays... Your not welcome here.... There's no business for you to boycott here... We don't do business with gays... My property... My choice... and what's with forcing someone to do business with you that does not want to do business with you ???? That logic says in the name of tolerance you must... NO, I DON'T... The gays pay my taxes and other payment, they have a say... I pay my taxes and payments... It's my property... My choice... I even have other tenants not wanting gays... Therefore, NO GAYS. Owners choice.

jusme101. how 'bout letting us know the name of your business? i certainly would have no trouble boycotting you and letting everyone else know about your views on customer service. so put your money where your mouth is. tell us.

It's amazing to hear these intolerant comments. Some people actually believe that you can do whatever you want if you are a private business. How naive. We used to be a much more tolerant place. Aue. Diversity is a good thing. No one is preaching lesbianism just the freedom and right to purchase services without fear of discrimination and retaliation. January 1st our civil union bill will go in to effect. This is one step towards equality for all and this makes me proud to live in Hawai'i.

Morally tolerable ??? It's my business, my property, my choice... I choose to do business with whomever I choose to do business with... My freedom of choice... comes from being owner of "My Property".... It's got nothing to do with diversity... It's called my property... It's called my right. I... Owner... Choose... Whom... To... Do... Business.... With.... and I choose not to rent to gays either. You as gay, also have the right to take your business elsewhere.... That is your right...

It may be “legal” to discriminate against whomever you choose to do business w/ but is it morally tolerable? You open up a business to the public but you pick and choose whose money you’d like to take? How do you sleep at night? I don’t remember in the article it saying that these lesbians were trying to shove lesbianism down your throat or crawl into your bed at night or attempting to harm you physically. If you can’t handle diversity maybe you shouldn’t be a “small” business owner in Hawai’i because you definitely represent the people of Hawai’i terribly. Maybe you should open a B&B in the middle of a close minded, ignorant, all-American state that makes it ok to inbreed. Oh but that might make you “uncomfortable”. You shouldn’t judge those that pay your bills especially while we are going through a “recession”. Financially I don’t think that’s smart. Bottom line discrimination is intolerable regardless of race or sexual orientation. Ps. Heaven forbid you have gay/lesbian children or grandchildren. You might get arrested for negligence. Karma is inevitable…hope you have all your paperwork in line to run a small business. CC: Kingston10
