Hawaii Superferry staying on Oahu for now

The Hawaii Superferry suspended service to Kauai indefinitely Tuesday over safety concerns.

The move comes just one day after a court blocked its Maui route temporarily.

The Coast Guard was weighing how to further secure Nawiliwili Harbor. The governor also had concerns. Both asked the Superferry to hold off at least for tonight.

The company went even farther, saying it's not budging until safety can be assured.

It's not how the Hawaii Superferry envisioned its first week of service, tied up at the Honolulu pier. Monday a judge halted service to Maui, and on Kauai protestors caused the ship to turn away.

"We're afraid they'd be in the water again, trying to stop a huge vessel on a surfboard, and that's a recipe for a serious problem," Gov. Linda Lingle.

The governor asked the Superferry to cancel at least one evening trip. The company said the U.S. Coast Guard also had concerns. Superferry says despite the delays the protestors have not won.

"These small groups of people that are really having an unusual impact and denying people the freedom to have choice, it think it's really solidifying support for us," said John Garibaldi of Hawaii Superferry.

Even those critical of the operation are pleased with the latest move.

"I was very concerned that it was growing out of control, so now we'll have the cooling-off period that I was asking for," said Sen. Gary Hooser of Kauai.

Maui service is also suspended until a court decides whether the vessel can operate while an environmental assessment is underway.

The governor says the state will ask the Maui court Wednesday to weigh more than just any environmental harm.

"Clearly there are substantial harms to both Superferry and the state if they're not allowed to continue operate,” Lingle said. “They won't be able to make their loan payments. They won't be able to make payments to the state so we can pay the bonds that we sold and we're responsible for."

The Superferry said they have enough financial support from the ownership group to get through these days sitting idle.

Forty dollars in state bonds paid for the harbor improvements that triggered the environmental assessment. The governor says the legal ramifications could be widespread in terms of environmental scrutiny for other projects.

"We don't really know how far reaching this is,” Lingle said. “If you think about it, it's not just the harbors. What about the airports?"

Besides the court opinion, lawmakers say they'll take a harder look at other harbor users than just the Superferry including the cruise ships.

“Not that everyone should do an environmental impact statement,” Hooser said, “but we definitely need to look at our regulations, look at our rules, and do a better job of regulating those industries."
