A Maui Police Department sergeant was expected to appear in court on Friday for sexual assault allegations by a 15-year-old girl.
Bailey was indicted on four counts of third-degree sexual assault following allegations of sexual misconduct involving the 15-year-old girl on May 21.
On Friday, the court was informed by the state that the motion to comply would not be heard. The case has been continued to July 31.
Bailey has been on unpaid administrative leave until further notice.
