The federal agent accused of fatally shooting a Kailua man in Waikiki is once again asking for the case to be moved to federal court.
Last August, a judge denied the motion, but the lawyer for Christopher Deedy is appealing, saying his client is a federal employee and is entitled to present his defense in federal court.
Deedy is accused of killing Kollin Elderts in 2011 while on state department business for the Asia-Pacific Economic Cooperation.
A judge will decide whether to move the case.
Deedy's murder trial is set to begin on July 8 in Circuit Court.
