New Evidence in Sex Assault Case Which Happened nearly a Year and Half Ago

DNA evidence has helped Honolulu prosecutors file charges in a sex assault case that remained unsolved for nearly a year and a half.

The suspect Mark Heath just recently pleaded guilty to other sex assault charges surrounding UH break-ins..

During a three month span last summer and into the fall UH Manoa coeds were on edge after dorm break-ins and a sexual assault.

It all ended in November when HPD nabbed Mark Heath.

Less than four months ago heath pleaded guilty to burglary and sex assault charges.

That meant the convicted felon had to give DNA samples.

Vicki Capp, the deputy prosecutor says, "The instant case remained unsolved until the suspect's DNA was collected in criminal number 07-12254 and the suspects buccal swab was compared with the victim's vaginal swab and positive identification was made."

Prosecutors say DNA evidence puts heath at the scene of a sex assault in waikiki in april of last year.

Honolulu Prosecutor Peter Carlisle says, "It hasn't happened with a great deal of frequency, but remember the greater you expand the databases the more likely you are to get that type of match."

Carlisle can't speak specifically about the heath case, but he says DNA evidence has helped greatly in solving crimes.

"Think of the way crime scenes were treated before we understood finger prints. I mean a great deal of information was lost. Now understanding the necessity, or the potential of biological testing and possible biological matches."

Heath is scheduled to be back in court tomorrow, where he has filed a motion for supervised release.

Early next month he is expected to be sentenced for the Manoa crimes.
