Debate Over Random Drug Testing of Hawaii Teachers

The debate over random drug testing of Hawaii teachers spreads across the World Wide Web.

Teacher, after teacher, after teacher. All speaking out against what their union agreed upon. To implement a random drug and alcohol testing program.

Now, the Hawaii State Teachers Association is also speaking out.

"Random drug testing, the way the state is proposing it, is unconstitutional," says Mike McCartney, Hawaii State Teachers Association, Executive Director.

Thursday, HSTA sent a letter to the Department of Education listing what they can and can't do.

"We are committed to doing reasonable suspicion drug testing right away it's just a matter of making sure we do random drug testing correctly," says McCartney.

The union's executive director says no contract can override a person's constitutional right to privacy. Whether they sign to it or not.

And if the state doesn't re-work the agreement, they could face huge lawsuits. Some teachers have even hinted they're waiting to sue as soon as random drug testing enters the classroom.

"So I say lets take a little extra time to get it done right to avoid legal problems for the state," says McCartney.

But, the only problem the state has is with the union not holding up their end of the bargain.

Governor Linda Lingle said Friday -"HSTA leaders have made a mockery of the collective bargaining process."

The state then filed a complaint against HSTA, the second time in two months. Still, the union isn't backing down.

"We're proposing to take this to the Hawaii Labor Relations Board," says McCartney.

Asking for a federal mediator to solve this debate once and for all.

The teachers union believes this step will help all parties reach a mutual and lawful agreement.
