Contest Rules

  1. No purchase necessary to win. Void where prohibited.
  2. The Contest is open to all legal residents of Hawaii and active duty military and their dependents stationed in Hawaii. Winner must be 18 years of age and have a valid driver’s license as of 10/20/09. Void where prohibited. Employees of Subway, Outfitters Kauai, Sheraton Resorts, Go Airlines and its marketing agencies, KHON-TV, & Fox Broadcasting Company, News America, Inc., Fox Interactive Media, their parent, subsidiary, affiliated and related entities, and the officers, directors, employees, licensees and assignees of each, (hereinafter collectively referred to as “the Sponsors”), and their immediate families (parent, child, sibling and spouse) are not eligible to enter. The Contest is subject to all federal, state, and local laws and regulations. Entrants agree to be bound by these Official Rules and their participation constitutes acceptance of the terms and conditions contained herein.
  3. Proof of age, residency and a valid driver’s license will be required before prizes are awarded.
  4. The information submitted by you during the registration process includes your name, email, and telephone numbers ("Personal Information") and will only be used by Sponsors in accordance with applicable data protection regulations and the Privacy Policy of each of their websites, for the purposes of administrating your participation in the Contest.
  5. Beginning October 20, 2009, the contest will be advertised on khon2.com, and entry forms and photo submissions will be available via khon2.com.
  6. To submit an entry and photo via the U.S. Postal service, send a postcard to: “Healthy Hawaii Photo Contest”, c/o KHON2, 88 Piikoi Street, Honolulu, HI 96814. Mail-in requests are limited to one entry per person. MUST include full legal name and primary and secondary phone contact numbers. Email address optional.
  7. To qualify to win, contestants must complete the on-line entry form or send a postcard with required information. A primary and secondary contact number must be provided. Entries deemed by KHON2 to be partial, incoherent or nonsensical will be disqualified.
  8. All completed entries must be submitted between 10/20/09 to 11/04/09, no later than 12pm HST.
  9. Submitted Image. The photo submitted must be themed as living healthy in Hawaii. By entering the Contest, you expressly agree not to submit an image or content ("Submission") that is unlawful, libelous, slanderous, defamatory or invasive of another person's right of privacy or right of publicity, or that Sponsors may reasonably deem harmful, vulgar, obscene, derogatory, pornographic, abusive, harassing, threatening, hateful, objectionable with respect to race, religion, creed, national origin or gender, or otherwise unfit for publication. Sponsors shall not be liable in any way for a Submission. Sponsors shall have no obligation to monitor the Submission provided by you to Sponsors, but may do so at their discretion. Any Submission that, in the sole discretion of Sponsors, is considered inappropriate or unsuitable for publication will be deemed ineligible by Sponsors, and Sponsors may, in their sole discretion, remove a Submission from the Contest Site. The Sponsors will not return any Submissions submitted on or through the Contest Site, nor those Submissions mailed to the Contest Site.
    Except where prohibited, by entering this Contest, you consent to the use of your name, photo and/or likeness, biographical information, Submission and statements attributed to you for advertising and promotional purposes without additional compensation. As such, you hereby grant to Sponsor a non-exclusive, fully transferable, perpetual, irrevocable, royalty free, fully paid up right and license to adapt, edit, modify, publish, promote, reproduce, distribute, publicly display and perform and make derivative works based on your Submission in any and all media as Sponsors see fit for any reason, to identify you as the author of the Submission, and to authorize others to do any of the above without any obligation to compensate you.
    You represent and warrant to Sponsors that (i) you are the sole and exclusive owner of your Submission, or that you have all right and authority to grant the rights in the Submission to Sponsors described herein; (ii) you have obtained any and all releases necessary from all persons depicted in the Submissions, including, without limitation, releases in the context of rights of privacy and rights of publicity; and (iii) in the event that a person depicted in a Submission is under eighteen (18) years of age, you are the parent or legal guardian of such person, or if you are not the parent or legal guardian, you have obtained all appropriate permissions and releases from the parent or legal guardian of the person in question, to submit the Submission for the Contest.
  10. Grand Prize Winner announced on Monday, November 9, 2009.
  11. A total of one (1) Grand Prize will be awarded. The “grand prize” winner is allowed to bring three (3) guests. Winner and guests must travel together.

      1. Kipu Zipline Safari Tour for four (4) from Outfitters Kauai
      2. Waimea Canyon Bicycle Downhill Tour for four (4) from Outfitters Kauai
      3. One standard room for a family of four (4) for three (3) nights for at the Sheraton Kauai Resort. Changes to the room are at the sole discretion of the Hotel and may result in additional charges.
      4. The “Sponsors”, KHON2-TV and its parent, subsidiary, related and affiliated companies and their respective officers, directors employees and agents shall be released and discharged from any and all legal claims, losses injuries, demands, damages, actions, and /or causes of actions which arise out of and/or in any way related to the prize, the receipt, use and/or enjoyment of the prize and/or the Promotion.
  12. Odds of winning depend on the number of entries received.
    1. Winners will be notified by telephone.
    2. Grand Prize Winner will be notified on Monday, 11/9/09.
  13. By entering this giveaway, entrants accept and agree to be bound by the rules and decisions of this contest which are final, binding and conclusive on all matters relative to this promotion. Entry constitutes permission to use winner’s name, address, photograph of self/friends or family, and/or voice recordings for publicity purposes without additional compensation or permission, except where prohibited by law. Sponsors reserve the right to disqualify entrants who fail to follow these official rules and regulations or who make any misrepresentations relative to the promotion, drawing and redemption of prizes.
  14. Winner may not substitute or change prizes unless stipulated in prize letter(s). Prizes are not transferable. All Federal, State, and Local taxes on prizes are the responsibility of the winner.
  15. The “Sponsors”, and all of the agencies, companies, corporations, affiliates, subsidiaries, parents and related companies, successors and assigns, local corporate advertising cooperative and their respective directors, officers, employees and agents, including advertising and promotion agencies and the prize suppliers, from all advertisements are not responsible for any negligence, claims, liability, injury or property loss or other damages of winners arising from, or in connection with the prizes awarded or participation in this promotion.
  16. Offer is subject to all applicable laws and regulations and is void where prohibited. Sponsors are not responsible or liable for lost, late, incomplete, misdirected, not received, stolen, mutilated, or illegible entries.
  17. For a copy of these official rules, send a hand printed request and self-addressed stamped envelope to be received by 11/9/09 to: “Healthy Hawaii Photo Contest”, c/o KHON2, 88 Piikoi Street, Honolulu, HI 96814.
  18. KHON2 will award the winner all prize letters. The prizes are at the sole discretion of the Sponsors. Upgrades, transfers, extensions or changes are at the sole discretion of the Sponsors.
  19. Winner must sign an acceptance letter attesting to all of the above.
  20. KHON2 and the contest sponsors reserve the right to disqualify any entrant at any time for any reason.
